    Acceptance of Terms

    By engaging Mountain Valley Welding LLC for any welding, fabrication, or related services, you agree to be bound by these Terms and Conditions. These terms apply to all services provided by Mountain Valley Welding LLC.

    Services Provided

    Mountain Valley Welding LLC provides the following services:

    • Custom metal fabrication and welding services
    • Mobile and on-site welding services
    • Structural steel work and framing
    • Gates, railings, and architectural metalwork
    • Agricultural and commercial fabrication
    • Emergency repair and maintenance services

    Quotes and Estimates

    • All quotes and estimates are provided free of charge and are valid for 30 days from the date of issue
    • Quotes are estimates only and final costs may vary based on actual project requirements
    • Additional work requested after project commencement will be quoted separately
    • Material costs are subject to market fluctuations and may change without notice

    Payment Terms

    • Payment is due upon completion of work unless otherwise agreed in writing
    • For projects exceeding $5,000, a 50% deposit may be required before work begins
    • We accept cash, check, and major credit cards
    • Late payments may incur a 1.5% monthly service charge
    • Client is responsible for all collection costs and attorney fees if payment becomes delinquent

    Warranties

    Mountain Valley Welding LLC warrants our workmanship and materials as follows:

    • Workmanship: 1 year warranty on all welding and fabrication work
    • Materials: Warranty coverage as provided by material suppliers
    • Warranty covers defects in workmanship under normal use conditions
    • Warranty does not cover damage from misuse, abuse, or normal wear and tear
    • Warranty is void if work is modified by others without our written consent

    Liability Limitations

    Mountain Valley Welding LLC's liability is limited as follows:

    • Our total liability shall not exceed the total amount paid for the specific project
    • We are not liable for consequential, incidental, or indirect damages
    • Client assumes responsibility for ensuring proper permits and compliance with local codes
    • We carry appropriate insurance, but client should verify coverage meets their needs

    Client Responsibilities

    The client is responsible for:

    • Providing accurate project specifications and requirements
    • Obtaining necessary permits and approvals
    • Providing safe and accessible work areas
    • Timely payment according to agreed terms
    • Notifying us of any changes or issues promptly

    Project Changes and Cancellations

    • Changes to project scope must be agreed upon in writing
    • Additional work will be quoted separately and may affect project timeline
    • Cancellation after work has begun may result in charges for completed work and materials
    • We reserve the right to suspend work for non-payment or unsafe conditions

    Dispute Resolution

    Any disputes arising from our services will be resolved as follows:

    • First, we will attempt to resolve disputes through direct communication
    • If direct resolution fails, disputes will be resolved through binding arbitration
    • Arbitration will be conducted in Montezuma County, Colorado
    • Each party will bear their own legal costs unless otherwise determined by the arbitrator

    Governing Law

    These Terms and Conditions are governed by the laws of the State of Colorado. Any legal action must be brought in the courts of Montezuma County, Colorado.
